The following is how FT dealt with a complaint about a strata agent who directly benefited, at the expense of the owners corporation, from the agents lack of knowledge.

I cannot beleive how weak a response this is.Unless your agent is acting in such a fashion that criminal charges are waranted then your agent acts with a large degree of impunity as no one is going to make them act in the public interest.I think if FT were to actually enforce failures by agents to follow the legislation then the strata managment industry would potentially collapse.This is how i was fobbed off.

I refer to your correspondence received about the management of SP ***** by ***** Strata (the Agency).

From the assessment Fair Trading conducted, it appears the Agency may have breached relevant legislation administered by NSW Fair Trading.

Mr ********** , Licensee in Charge, was provided education under the Property, Stock & Business Agents Act 2002 and its associated Regulation and the Strata Schemes Management Act 1996 & 2015 and the associated Regulations to ensure in future that appropriate action is taken in relation to compliance with the legislation.

NSW Fair Trading promotes a fair marketplace for consumers and traders by maximising traders' compliance with regulatory requirements. In doing so, Fair Trading also seeks to educate and engage with both consumers and traders on issues that affect their rights and obligations.

We adopt an integrated approach to promoting voluntary compliance. Education and raising awareness is the first step, as a core function of our business is to engage with businesses to assist them in complying with the law. NSW Fair Trading has assessed the issues raised and has determined that we will not be pursuing any compliance action at this time.

The information you have provided will be retained on Fair Trading's complaint management database which is used to monitor marketplace trends and practices and assists with the development of specific consumer protection strategies.
